General Terms and Conditions iCrowd.co

We are happy to welcome you to iCrowd.co, the crowd sourcing marketplace, a platform for IT hiring , here and after to be referred to as “iCrowd.co”.
These general terms of use are in force since June 1st, 2015 and are last amended on August 16th, 2021 and are applicable for all marketplace participants.
iCrowd.co recognizes the below three parties as direct and indirect participants on the marketplace:
Direct iCrowd.co Participants:
- Companies (organizations) looking to hire IT professionals as permanent hires for themselves, freelance consultants for themselves or permanent and freelance consultants for third parties, here and after to be referred to as “Company”
- Recruitment agencies, looking to deliver candidates interested in permanent and / or freelance job opportunities of companies on the marketplace, here and after to be referred to as “Vendor Partner”.
Indirect iCrowd.co Participants:
- IT professionals interested in permanent and / or freelance job opportunities of companies on the marketplace, shared to them by Vendor Partner, here and after to be referred to as “Candidate”.
Therefore, to ensure all parties are clear about their role and responsibilities, we have created clear rules for using the iCrowd.co marketplace. Since iCrowd.co is a “closed” marketplace, the direct participants - Company and Vendor may only participate on the marketplace after:
  1. Have met the iCrowd.co criteria and have been approved by iCrowd.co
  2. Have signed a specific Contract Agreement provided by iCrowd.co, in which hiring fees, payment terms and hiring guidelines have been further outlined in detail.
  3. Have been officially onboarded and have received valid login credentials to access the iCrowd.co platform.
  1. No direct contact with iCrowd.co, unless agreed upon with Vendor Partner, on a case to case basis
  2. No direct contract with iCrowd.co, unless agreed upon with Client and Vendor Partner, on a case to case basis
  3. No access to the iCrowd.co platform
iCrowd.co is a software platform with sole purpose to enable Companies to hire IT professionals on permanent or contract/freelance basis. For this iCrowd.co enables Vendor Partners to introduce / assign Candidates to job openings of Company, shared, published on the marketplace. iCrowd.co shall not be acting as Company, employing Candidates on its payroll nor is iCrowd.co a Vendor Partner, introducing/assigning Candidates from its database. iCrowd.co has no contact nor relationship with Candidates introduced /assigned to Company’s job openings. iCrowd.co does not guarantee hiring. iCrowd.co and its reputation shall be kept free from harm.
Other Provisions:
IT World Web.com Enterprise B.V. (conducting its business under its brand name “iCrowd.co”) has a registered office on Dussendijk 4, 4271XL, Dussen, the Netherlands. iCrowd.co has VAT number: NL85359287B01, RSIN/FI number: 85359287 and Chamber of Commerce registration number: 59659955.
iCrowd.co reserves her right to make amendments to these general terms and conditions. Changes made shall be announced within a reasonable timeframe only to direct users with valid login credentials and active accounts on the iCrowd.co marketplace.
By using the services of iCrowd.co you agree with the general terms of use set out here. iCrowd.co reserves the right to amend these general terms of use whenever necessary and ensure fair play for all direct and indirect participants.
Role and Responsibilities of Company
Company shall only post (publish, share) with iCrowd.co job openings which are:
- real job openings (based on real hiring need) with clearly specified job description including roles and responsibilities, job location, required candidate experience, specific education (if any), salary (freelance / contract rate) detail, if the job opening is permanent hiring or freelance / contract position. In the case of freelance / contract roles, the job openings must clearly specify the expected contract duration and if the freelancer/contract is required to be present on site (from the Company premises), remote only or a combination of these two options.
Once the job opening is posted (published, shared) with iCrowd.co it is a subject to further iCrowd.co approval. iCrowd.co may request further clarifying information related to the job opening, team, company, hiring manager, salary/rate, or any other information that is required for the further approval of the company job opening and sharing it with Vendor Partners.
iCrowd.co reserves her right to decline the approval and cancel and delist job openings deemed unproper, misleading, false or in any kind deemed unjust. Job openings published on the marketplace and shared with Vendor Partners are considered as serious business dealing that has a high degree of resulting into a placement / contract fee.
Received CV’s from iCrowd.co
- CV’s and corresponding candidate information (which may be in any form such as: contact details, personal information regarding personal situation, background, history, relocation plans or any other form of information provided by iCrowd.co) shared by Vendor Partner shall be treated by Company with utmost secrecy and shall fall under the GDPR Regulations (the EU General Protection Regulations) which came into force on the 25th May 2018.
- Company shall not consider candidate’s CV and shared candidate information as own, use it outside of the scope and context of the job opening for which the Candidate’s CV and information have been shared by iCrowd.co. Company shall not use the Candidate’s CV and information to enhance the Company’s own CV database.
- Company shall not sell, share or in any way disclose the candidate’s CV and shared candidate information with a third party which has no agreement with, no other relationship, nor participation on iCrowd.co.
- Candidate’s CV and shared candidate information remains at all times property of the Vendor Partner until candidate becomes an official employee of the Company through the mode of hiring facilitated by iCrowd.co. Freelance / contract engagements between Candidate and Company, facilitated by iCrowd.co, does not fall under consideration of permanent employee relationship of the parties and does not result into official employment.
- In case of unfair play, Vendor Partner has the right to invoke, cancel, withdraw the Candidate’s application for the specific job opening and /or has the right to advice the Candidate against his participation in the hiring process with Company.
- Company shall provide timely feedback, within the set by iCrowd.co timeline, and inform iCrowd.co of its intentions to continue or discontinue the hiring process with the applicant. Failing to provide feedback within the set by iCrowd.co timeline may result into Candidate’s and/or Vendor Partner’s intentions to drop (discontinue) the application from the hiring process and/or introduce the Candidate to job openings of other Companies on iCrowd.co, outside of the scope of the job opening to which the Candidate was introduced.
Interview Process
When inviting Candiate for an interview, Company shall provide clear information including, but not limited to, date and time of the interview, interviewer name (and or contact details, if needed), interview mode (telephonic, online, face to face), interview preparation materials.
- Company shall provide post-interview feedback within the set by iCrowd.co timeline, and inform iCrowd.co of its intentions to continue or discontinue the hiring process with the applicant. Failing to provide feedback within the set by iCrowd.co timeline may result into Candidate’s and/or Vendor Partner’s intentions to drop (discontinue) the application from the hiring process and/or introduce the Candidate to job openings of other Companies on iCrowd.co, outside of the scope of the job opening to which the Candidate was introduced.
Offer, Hiring Process
At all times shall Company inform iCrowd.co that it has an intent to or an interest in releasing an offer or hiring the Candidate. Company shall at all times keep iCrowd.co informed about its intentions regarding all introduced by iCrowd.co Candidates. Failure to inform iCrowd.co may result into Candidate’s and/or Vendor Partner’s intentions to drop (discontinue) the application from the hiring process and/or introduce the Candidate to job openings of other Companies on iCrowd.co, outside of the scope of the job opening to which the Candidate was introduced.
Candidate Satisfaction, Candidate Experience and iCrowd.co Reputation Badge
Candidate experience and satisfaction are major cornerstones on iCrowd.co. Therefore Company shall provide timely as well as clear and understandable feedback to iCrowd.co within the set by iCrowd.co timeframes.
Company shall follow the process set out by iCrowd.co and shall use the “action buttons” made available in each candidate email. Company is made aware that the Company’s iCrowd.co reputation badge is used by Vendor Partners to make educated decisions on introducing their Candidates to Company’s job openings. Any sudden backward (downgrade) changes (eg from Gold to Silver, Silver to Bronze) may result in Vendor Partner’s and/or Candidate’s decision to withdraw from the hiring process with Company.
Unfair play & Non Solicitation
Company may come into the possession of information, contact details of any of Vendor Partner’s employees as part of the recruitment process or any other information that Company would have not come into possession of otherwise if not for its participation on iCrowd.co. Therefore Company shall not use, share with third parties, any information it has come into possession during its participation on iCrowd.co. Company shall not solicit Vendor Partner directly or indirectly for the purpose of business or other business dealings or for any other purpose. iCrowd.co shall be the only channel of communication exchange between all parties involved, namely Vendor Partner, Company and Candidate. Failure to comply may result into removing the Company from participation on iCrowd.co and further blacklisting on the marketplace. Failure to comply may result to prosecution and court proceedings under Dutch law in the courts of justice in the Netherlands.
Complains:
In case of complains you may reach out to our legal department by sending an email to: legal@icrowd.co. In the email content, explain as specifically as possible the nature of your complaint, job opening, candidate, vendor partner it is regarding or any matter your complaint has a relationship to. iCrowd.co shall respond within 14 days from the day the complaint has been submitted.
Role and Responsibilities of Vendor Partner
Accepting to work on job openings:
- Vendor Partner may use Company’ iCrowd.co reputation badge to decide to work on a job opening of Company.
- Once Vendor Partner accepts to work on a job opening on iCrowd.co, the Vendor Partner shall take the responsibility to introduce/assign relevant Candidates to the job opening in a timely manner and / or within set in the job opening deadline.
- Accepting to work on a job opening on iCrowd.co and not introducing/assigning any relevant, within the set job opening salary/ rate interested Candidates, may result into discontinuing the Vendor Partner participation on iCrowd.co
- Vendor Partner shall at all times aim at introducing /assigning only genuinely interested in the job opening Candidates, having clear intentions to join the Company as a permanent employee / contractor or freelancer if/when the Company extends a suitable permanent employment offer or the Freelancer’s rate falls within the set boundaries by the Company.
- Vendor Partner shall share with the Candidate (before introducing/assigning him/her to the job opening) the job description including roles and responsibilities, job location, required candidate experience, specific education (if any), salary (freelance / contract rate) detail, if the job opening is permanent hiring or freelance / contract position.
- In the case of permanent hiring, the Vendor Partner shall ensure the Candidate is well informed about the gross / net monthly/annual salary provided by the Company based on the local taxes and regulations governing the Company’s settlement.
- In the case of freelance / contract roles, the Vendor Partner shall at all times have agreed with the Candidate on the job opening’s rate for which the candidate shall be introduced / assigned. In case available in the job opening, the Vendor Partner shall communicate to the Candidate the expected contract duration and if the freelancer/contract is required to be present on site (from the Company premises), remote only or a combination of these two options.
- In case the job opening is regarding sub-contracting, the Vendor Partner shall provide on iCrowd.co an all-inclusive rate (rate including the total rate to iCrowd.co including Vendor Partner margin and sub-contracted Candidate’s rate/salary). The Vendor Partner shall ensure the Candidate is well aware of the exact contractual relationship between him/her and the Company.
- iCrowd.co reserves her right to reject, black list and / or disallow Candidate’s introduction / assigning to job opening any Candidate it deems as unproper, misleading, false or in any kind deemed incorrect. Each Candidate introduced / assigned by Vendor Partner is considered as seriously interested in the job opening for which he/she has been introduced / assigned and for which there is has a high degree of certainty to result into a placement / contract fee.
Introduced / Assigned Candidates to job openings on iCrowd.co
- Vendor Partner shall ensure that each Candidate (prior his / her introduction / assigning to a job opening on iCrowd.co) has read and accepted the general terms and conditions on iCrowd.co and the specific terms and conditions of the job opening for which he/she wants to be introduced / assigned. The acceptance of these terms and conditions is only possible when a job is shared with the Candidate and the Candidate signs with digital signature (provided in the form) and confirms by clicking on the “Confirm and Accept” button.
- CV’s and corresponding candidate information (which may be in any form such as: contact details, personal information regarding personal situation, background, history, relocation plans or any other form of information provided to iCrowd.co) shall be correct and just.
- Candidate’s CV and shared candidate information remains at all times property of the Vendor Partner until candidate becomes an official employee of the Company through the mode of hiring facilitated by iCrowd.co. Freelance / contract engagements between Candidate and Company, facilitated by iCrowd.co, does not fall under consideration of permanent employee relationship of the parties and does not result into official employment.
- In case of unfair play, Vendor Partner has the right to invoke, cancel, withdraw the Candidate’s application for the specific job opening and /or has the right to advice the Candidate against his participation in the hiring process with Company.
- Vendor Partner shall keep iCrowd.co informed about any changes in the Candidate’s personal and / or professional situation that might result into changes in her applicant’s situation with which he/she has been introduced /assigned on iCrowd.co.
- iCrowd.co shall be informed immediately in the case of Candidate having intentions to discontinue the hiring process for the job opening for which he/she has been introduced /assigned. Failing to provide such feedback may result into Vendor Partner’s delisting of participation on iCrowd.co
Interview Process
When Candidate introduced / assigned by Vendor to a job on iCrowd.co is invited for an interview, the Vendor Partner shall provide all available information including, but not limited to, date and time of the interview, interviewer name (and or contact details, if needed), interview mode (telephonic, online, face to face), interview preparation materials.
- Vendor Partner shall ensure Candidate is well prepared for his / her interview and has all available details about but not limited to, the job opening and Company.
- Vendor Partner shall follow-up with Candidate before the interview to ensure Candidate is on time and well prepared. In case of any technical or other delays and /or disturbances, the Vendor Partner shall inform iCrowd.co at least 1 hours prior to the interview time slot
- Vendor Partner shall follow-up with Candidate after the interview with the Candidate and provide the post-interview feedback with iCrowd.co
Offer, Hiring Process
- Candidates in Offer and joining (post offer acceptance) stage shall not be introduced to other job openings of other Companies on iCrowd.co.
- At all times shall Vendor Partner inform iCrowd.co on the Candidate’s intent to or an interest in accepting/ declining an offer extended by Company on iCrowd.co.
Candidate Satisfaction, Candidate Experience and Company’s iCrowd.co Reputation Badge
Candidate experience and satisfaction are major cornerstones on iCrowd.co. Therefore Vendor Partner shall provide all available feedback and information provided by iCrowd.co to Candidate.
Vendor Partner shall follow the process set out by iCrowd.co and shall use the Company’s iCrowd.co reputation badge to make educated decisions on introducing Candidates to Company’s job openings and navigating further throughout the hiring process. Any sudden backward (downgrade) changes (eg from Gold to Silver, Silver to Bronze) in Company’s iCrowd.co reputation badge may signal the Vendor Partner on deteriorating Company’s performance on iCrowd.co and Vendor Partner may be well advised to withdraw its Candidate from the hiring process with Company.
Vendor Partner shall at all times keep iCrowd.co well informed about its Candidates who are introduced / assigned to job openings on iCrowd.co, their decisions, intentions and interest in the hiring process where they are part of.
Unfair play and Solicitation
- Vendor Partner may come into the possession of Company information, contact details of any of Company’s employees who might be part of the hiring process or any other information that Vendor Partner would have not come into possession of otherwise if not for its participation on iCrowd.co. Therefore Vendor Partner shall not use, share with third parties, any information it has has come into possession during its participation on iCrowd.co. Vendor Partner shall not solicit in any way Company directly or indirectly for the purpose of business or other business dealings or for any other purpose. iCrowd.co shall be the only channel of communication exchange between all parties involved, namely Vendor Partner, Company and Candidate. Failure to comply may result into removing the Vendor Partner from participation on iCrowd.co and further blacklisting on the marketplace. Failure to comply may result to prosecution and court proceedings under Dutch law in the courts of justice in the Netherlands.

Role and Responsibilities of Candidate
Accepting to be introduced/assigned to job openings of Companies on iCrowd.co:
- Candidate shall only be introduced / assigned to job openings of Companies on iCrowd.co through a Vendor Partner, who already is or post iCrowd.co approval qualifies to act as a recognized vendor partner on iCrowd.co.
- Candidate shall not apply directly or indirectly to job openings of companies on iCrowd.co.
- Throughout the hiring process, Candidate shall be provided (by Vendor Partner) with iCrowd.co and Companies’ hiring through iCrowd.co non-disclosable information. Candidate shall not use, misuse, share this information with non-relevant to the hiring process parties, which are not part of the non-disclosure agreement guiding all parties, direct and indirect participants on the iCrowd.co marketplace.
- For each job opening posted by a company on iCrowd.co, iCrowd.co has made available specific terms and conditions which shall be accepted and signed by Candidate prior Candidate’s introduction/ assigning to a job opening on iCrowd.co.
- The acceptance of these job specific terms and conditions is only possible when you as Candidate sign with your digital signature (the option to sign is provided in the form) and confirm by clicking on the “Complete the Process” button.
- Candidate shall only click on the “Complete the Process” button if he/she is genuinely interested on the job opening of the Company on iCrowd.co.
- Dropping from the hiring process, post confirming and accepting the specific terms and conditions on iCrowd.co may at times have financial consequences for the Candidate. If that is the case, these financial consequences shall be made clear before the Candidate accepts the specific terms and conditions of the job opening.
- Candidate’s CV information, diploma’s, certificates and shared (with Vendor Partner and iCrowd.co) information during the hiring process shall be correct and just. Providing misleading, unjust, incorrect or false information may lead to suspension and blacklisting of your profile on iCrowd.co and may hinder your future applications for job openings, Vendor Partners and / or Companies members of iCrowd.co
- Once Candidate is assigned to a job opening on iCrowd.co, Candidate shall at all times keep Vendor Partner (and iCrowd.co) informed about any changes in the Candidate’s personal and / or professional situation that might result into changes in his/ her applicant’s situation.
- Vendor Partner shall be informed immediately in the case of Candidate having intentions to discontinue the hiring process for the job opening for which he/she has been introduced /assigned.
Interview Process
- Candidate shall make himself / herself available within a reasonable timeframe to attend interviews.
- In case of any technical or other delays and /or disturbances, the Candidate shall inform the Vendor Partner at least 1 hours prior to the interview time slot
- It is Candidate’s responsibility to make herself/himself aware of the job’s role and responsibilities, corresponding salary / daily rate, if relocation is required and request any information that is needed so she/he can make a decision and be introduced/assigned to the job opening of Company. Once Candidate accept to be introduced/assigned to the job opening of Company, Candidate consents with all company and job related information.
- Candidate shall at all times inform the Vendor Partner about changes in her/his personal and/ or professional situation that may be relevant to her/his application with Company.
- Candidate shall not disclose Company’s information, secrets to third parties.
Offer, Hiring Process
- When Candidate accepts an extended offer from Company and Candidate expresses intentions to join as a permanent employee or contractor/freelancer, then Candidate shall ensure that she /he brings this to fruition.
- Candidate’s declining to join Company as permanent employee or contractor/freelancer, post Candidate’s acceptance of an offer verbally and / or in a written format, signing any form of documentation or any other form of expressing intentions to join Company, shall be a considered as misleading and fraudulent and may result into any of the following: financial penalties, blacklisting of the Candidate on iCrowd.co.
